Welcome to Cowboy Trailers and Equipment LLC (“we,” “us,” or “our”). These Terms and Conditions (the “Agreement”) govern the use of our website and the rental of our trailers and equipment (“Services”). By accessing our website, requesting a quote, or renting our equipment, you agree to be bound by this Agreement. If you do not agree to any part of this Agreement, you must not use our Services.
1. Definitions
1.1 “Renter,” “Customer,” or “You”: The individual or entity renting or using our equipment and/or accessing our website.
1.2 “Equipment”: Includes all trailers, accessories, and other items made available by Cowboy Trailers and Equipment LLC.
1.3 “Rental Period”: The agreed-upon date and duration for which the Renter has reserved the Equipment.
2. Eligibility
2.1 Age and License: Renters must be at least 18 years of age and hold a valid driver’s license recognized by the State of Texas.
2.2 Insurance: Renters must provide proof of valid auto insurance prior to renting any Equipment.
2.3 Payment and Deposit: A valid credit or debit card is required for payment and/or to hold a security deposit.
3. Rental Period & Charges
3.1 Rental Period: The Rental Period begins at the time specified in the rental agreement and ends when the Equipment is returned and inspected.
3.2 Rates: Rental fees, deposits, and any applicable surcharges (e.g., taxes, late fees, cleaning fees) are detailed in the reservation or invoice.
3.3 Late Returns: Additional charges may apply for Equipment returned after the agreed-upon time.
4. Use of Equipment
4.1 Permitted Use: Equipment must only be used for its intended purpose and operated in a safe, lawful manner.
4.2 Prohibited Activities: You may not use the Equipment in any manner that is unsafe, illegal, or could cause damage.
4.3 Condition of Equipment: Equipment is provided in good working order. Renters must report any damage or malfunction immediately to Cowboy Trailers and Equipment LLC.
5. Care and Maintenance
5.1 Basic Maintenance: Renters are responsible for basic daily checks (e.g., hitch, tires, lights) during the Rental Period.
5.2 Damage: If the Equipment is damaged or lost during the Rental Period, the Renter will be liable for repair or replacement costs, unless covered by insurance.
5.3 Cleanliness: Trailers must be returned in reasonably clean condition. Additional cleaning fees may apply if the Equipment is returned excessively dirty.
6. Security Deposit
6.1 Deposit Requirement: A security deposit may be required prior to renting any Equipment. This deposit will be refunded upon return of the Equipment in good condition.
6.2 Deposit Deductions: We reserve the right to deduct from the deposit any unpaid fees, fines, tolls, or costs associated with damages to the Equipment.
7. Payment and Fees
7.1 Payment Methods: We accept major credit cards, debit cards, and any other forms of payment listed on our website or invoice.
7.2 Additional Charges: Renters are responsible for any traffic violations, toll fees, penalties, or other costs incurred during the Rental Period.
7.3 Refunds: All refunds will be processed according to our Cancellation Policy (see Section 8) or as otherwise stated in this Agreement.
8. Cancellation Policy
- Anytime prior to the start of your rental and receive a 75% refund.
If you decide to cancel your reservation, please notify us as soon as possible. Refunds are subject to processing times and may take several business days to appear on your statement.
9. Liability and Indemnification
9.1 Limitation of Liability: Cowboy Trailers and Equipment LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Equipment or Services.
9.2 Indemnification: You agree to indemnify, defend, and hold harmless Cowboy Trailers and Equipment LLC from any claims, damages, or expenses (including legal fees) arising out of your breach of this Agreement or your improper use of the Equipment.
10. Insurance
Renters are required to maintain valid auto insurance coverage, which may extend to rented trailers or equipment. We advise you to check with your insurance provider to ensure you have adequate coverage. Cowboy Trailers and Equipment LLC may offer supplemental coverage for an additional fee.
11. Privacy
Your use of our Services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information. By using our website or Services, you consent to the collection and use of information as described in our Privacy Policy.
12. Modifications and Termination
We reserve the right to modify these Terms and Conditions at any time, effective upon posting to our website. Continued use of our Services after such modifications indicates acceptance of the revised terms. We may terminate or suspend your access to our Services at any time for breach of these Terms and Conditions.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from this Agreement shall be resolved in the appropriate courts located in Collin County, Texas.
14. Entire Agreement
This Agreement, together with any reservation or rental documents, constitutes the entire understanding between Cowboy Trailers and Equipment LLC and the Renter regarding the subject matter herein and supersedes all prior or contemporaneous understandings.
