By using our website, requesting a quote, reserving, or renting from Cowboy Trailers and Equipment LLC (“we,” “us,” “our”), you (“Renter,” “Customer,” “you”) agree to these Terms & Conditions (the “Agreement”). If you do not agree, do not use our services.
1) Definitions
- Equipment: Any trailer, accessory, or item we provide.
- Rental Period: The reserved start date/time through return and inspection.
- Renter/Customer/You: The person or business renting/using the Equipment.
2) Eligibility Requirements
To rent, you must:
- Be 18+ and have a valid driver’s license recognized by Texas.
- Provide proof of valid auto insurance (towing vehicle insurance).
- Have a valid credit/debit card for payment and/or security deposit.
3) Rental Period, Minimum Charge, and Pricing
- Rental Period starts at the time shown on your reservation/rental agreement.
- Rental Period ends when the Equipment is returned and inspected.
- Minimum rental charge is 1 day (24 hours). We do not offer hourly rentals.
- Rates, deposits, and possible fees (taxes, cleaning, late returns, tolls/violations, etc.) are shown on your reservation/invoice.
Early Returns
- No refunds or prorated credits are provided for early returns (unless required by law or approved by us in writing).
Late Returns
- Returning late may result in additional charges.
4) Proper Use of Equipment
You agree to:
- Use Equipment only for its intended purpose and in a safe, lawful manner.
- Avoid any unsafe, illegal, or damaging use.
- Report any issue, damage, or malfunction immediately.
5) Care, Maintenance, and Cleanliness
During your rental, you are responsible for:
- Basic checks: hitch connection, lights, tires, and general safe towing condition.
- Any damage, loss, or theft during the Rental Period (unless covered by applicable insurance).
- Returning the Equipment reasonably clean. Excessive dirt/mud/debris may result in cleaning fees.
6) Security Deposit
- A security deposit may be required.
- Deposits are refunded after return/inspection minus any deductions for:
- Damage/repairs
- Cleaning fees
- Missing items
- Unpaid fees
- Tolls, citations, or penalties
- Any other amounts permitted by this Agreement
7) Payments, Fees, and Refunds
Payment Methods
- We accept major credit cards, debit cards, and other methods listed on our website/invoice.
Additional Charges
- You are responsible for tolls, traffic violations, penalties, towing/storage costs, and other costs incurred during your rental.
Refunds
- Refunds (if any) follow our Cancellation Policy below or what is stated in this Agreement.
- Early returns are not refundable and do not qualify for prorated credits (unless required by law or approved by us in writing).
8) Cancellation Policy
- Cancel before the rental start time and you may receive a 75% refund of rental charges paid (subject to any non-refundable fees disclosed at checkout, if applicable).
- Refund processing time may take several business days to appear on your statement.
9) Liability and Indemnification
- We are not responsible for indirect, incidental, special, or consequential damages related to use of the Equipment.
- You agree to indemnify and hold harmless Cowboy Trailers and Equipment LLC for claims, damages, losses, or expenses (including attorney fees) arising from:
- Your breach of this Agreement
- Improper/unsafe use
- Violations of law
10) Insurance
- You must maintain valid auto insurance on your towing vehicle that may extend to towing a trailer.
- We recommend confirming coverage with your insurance provider.
- Supplemental coverage may be offered for an additional fee where available.
11) Privacy
Use of our website/services is also governed by our Privacy Policy.
12) Changes to These Terms / Termination
- We may update these Terms at any time by posting changes on our website.
- Continued use after updates means you accept the revised Terms.
- We may suspend/terminate access for violations of this Agreement.
13) Governing Law
This Agreement is governed by Texas law. Disputes must be handled in the appropriate courts in Collin County, Texas.
14) Entire Agreement
These Terms, plus your reservation and rental documents, represent the entire agreement between you and Cowboy Trailers and Equipment LLC.

16) Included Items (Accessories) — Your Responsibility
Some rentals include additional items needed for operation (may include ramps, keys, straps, locks, and other accessories).
- You are responsible for returning all included items in good working condition.
- Lost, missing, or damaged items may be charged at replacement/repair cost.
17) Additional Commercial Trailer Rental Terms (Detailed)
17.1 Trailer-Specific Definitions
- Authorized Driver: You and any driver we approve/list.
- Trailer: The trailer identified in your agreement (or a substitute).
- Loss of Use: Daily rental rate × days unavailable due to damage/loss.
- Diminished Value: Value difference before damage vs. after repair (or salvage value).
17.2 Repossession / No Warranties
- We may repossess the Trailer at your expense if abandoned or used unlawfully or in violation of this Agreement.
- We make no warranties, including merchantability or fitness for a particular purpose.
17.3 Return Condition
- Trailer must be returned on time and in the same condition (normal wear excepted).
- If returned after hours, you remain responsible until we inspect.
17.4 Damage / Loss Responsibility
You are responsible for all damage, theft, or loss (even if not at fault), including:
- Repair costs or actual cash value if not repairable
- Loss of Use
- Diminished Value
- Missing equipment and related admin expenses
Accidents must be reported to us and to police within 24 hours.
17.5 Prohibited Uses (Examples)
Not allowed:
- Transporting hazardous/illegal materials
- Transporting living persons
- Towing under the influence
- Unauthorized drivers
- Fraud to obtain/extend rental
- Travel outside the U.S.
- Overloading beyond manufacturer limits
- Operating with insufficient clearance
- Operating in a way that worsens damage
- Improperly secured cargo
- Intentional/reckless damage
- Unauthorized signs/lettering/paint
17.6 Insurance (Trailer-Specific)
If stated in your rental documents, we may provide collision/comprehensive coverage with a deductible you are responsible for (“Dealer’s Deductible”). This does not cover personal property inside the Trailer. Liability coverage must come from your tow vehicle policy.
17.7 Charges / Late Fees / Cleaning
You agree to pay all charges due, including:
- Rental fees, taxes, tolls, fines/penalties
- Towing/storage costs
- Collection costs (including attorney fees)
- 5% late fee on overdue balances (if applicable)
- Up to $60 cleaning fee if returned substantially less clean
No refunds are given for early returns.
17.8 Deposit Use
We may apply your deposit to any amount owed, including estimated damages.
17.9–17.10 Modifications and Waivers
Changes must be in writing signed by us. No waiver is a waiver of future enforcement. If any part is unenforceable, the rest remains in effect.
Digital Signature Acknowledgment
By digitally signing, you confirm you have read, understood, and agree to this Agreement, and you authorize Cowboy Trailers and Equipment LLC to charge your card for amounts due, including later fees or violation assessments.
